Profile

Luke is an Associate in the Insolvency and Restructuring, Commercial Litigation and Construction practice teams.

Luke joined the firm as a paralegal in March 2021, prior to his admission as a solicitor in May 2022. Luke has experience appearing before the Federal Courts in most Australian states; the Supreme Courts of New South Wales, Queensland and Victoria; and all lower courts in Victoria and New South Wales. He has worked with several national restructuring and insolvency firms, including major appointees across the eastern seaboard. As a litigator specialising in insolvency, Luke’s practice focuses on all stages of the insolvency process, including debtor and creditor recovery and negotiations, business and asset sales, acting for plaintiffs and defendants in winding ups and bankruptcy proceedings, recovery of voidable transactions and breaches of directors’ duties, pursuing insolvent trading claims, and specialised insolvency and restructuring advice. Luke also frequently acts in commercial and construction litigation matters, including debt recovery and contract disputes.

In 2023, Luke was named a finalist in the Lawyers Weekly 30 under 30 for Insolvency.

Experience

  • Acting on insolvent trading claims, voidable transaction claims, director duties breaches, shadow and de-facto director proceedings, preference actions, and plaintiff and defendant side winding up hearings
  • Acting and advising upon Company restructuring, administrations and Deeds of Company Arrangements
  • Advising upon and drafting asset sale agreements, Deeds of Company Arrangement
  • Acting in application seeking Court declarations for reconstruction of lost trust deed, allowing liquidator to recover trust assets for the benefit of creditors
  • Acting in recovery proceedings for pooled group of companies, resulting in winding up of debtor entity for $26M+ of debtor ledger
  • Advising and commencing proceedings under key provisions of the Corporations Act (Cth), Bankruptcy Act (Cth), Personal Property Securities Act (Cth), Building and Construction Industry (Security of Payments) Act (NSW), contract and common law
